Habitability
The legal standard that a rental property must be safe and fit for human occupancy. In Tennessee, this means working plumbing, heating, electrical, structural soundness, weatherproofing, and compliance with building codes (TCA 66-28-304). A property that fails habitability standards gives the tenant legal remedies including repair and deduct, rent withholding, or lease termination. Maintain the property or face the consequences.
