Constructive Eviction
When a landlord's failure to maintain a property makes it uninhabitable, effectively forcing the tenant to move out. No heat in January, persistent sewage backup, or mold that makes occupants sick. The tenant does not have to stay and pay rent in unlivable conditions. If a court finds constructive eviction, the tenant can terminate the lease, stop paying rent, and potentially sue for damages.
