Disparate Impact
A fair housing violation that occurs when a policy that appears neutral disproportionately affects a protected class. You do not need discriminatory intent. A blanket ban on all criminal records, for example, has been found to disproportionately affect certain racial groups. The policy itself can be the violation. Screen consistently using criteria with a legitimate business justification.
