Operating Agreement

The internal document that defines how a business is owned and operated. For an LLC that owns rental property, the operating agreement specifies ownership percentages, decision-making authority, profit distribution, and what happens if a member wants out. If your rental is in an LLC without an operating agreement, you have a liability shield with no rules. That is a problem waiting to happen.
